EQUAL OPPORTUNITY IS THE LAW

It is against the law for this recipient of Federal financial assistance to discriminate on the following basis:

 

Against any individual in the United States, on the basis of race, color, religion, sex, national origin, age, disability, political affiliation or belief; and Against any beneficiary of programs financially assisted under Title I of the Workforce Innovation and Opportunity Act (WIOA), on the basis of the beneficiary’s citizenship/status as a lawfully admitted immigrant authorized to work in the United States, or his or her participation in any WIOA Title I-financially assisted program or activity. The recipient must not discriminate in any of the following areas: Deciding who will be admitted, or have access, to any WIOA Title I-financially assisted program activity; Providing opportunities in, or treating any person with regard to, such a program or activity; or Making employment decisions in the administration of, or in connection with, such a program or activity.
 

WHAT TO DO IF YOU BELIEVE YOU HAVE EXPERIENCED DISCRIMINATION

 

If you think you have been subjected to discrimination under a WIOA Title-I financially assisted program or activity, you may file a complaint within 180 days of the alleged violation with either:

 

The recipient’s Equal Opportunity Officer (or the person whom the recipient has designated for this purpose); or

The Director, Civil Rights Center (CRC), U.S. Department of Labor, 200 Constitution Avenue NW, Room N-4123, Washington, DC 20210.

 

If you file your complaint with the recipient, you must wait either until the recipient issues a written Notice of Final Action, or until 90 days have passed (whichever is sooner), before filing with the Civil Rights Center (see address above). If the recipient does not give you a written Notice of Final Action within 90 days of the day on which you filed your complaint, you do not have to wait for the recipient to issue that Notice before filing a complaint with the CRC.  However, you must file your CRC complaint within 30 days of the 90-day deadline (in other words, within 120 days after the day on which you filed your complaint with the recipient). If the recipient does give you a written Notice of Final Action on your complaint, but you are dissatisfied with the decision or resolution, you may file a complaint with the CRC.  You must file your CRC complaint within 30 days of the date on which you received the Notice of Final Action.

Es contrario a la ley que este destinatario de la asistencia financiera federal discrimine:

 

A cualquier persona en Estados Unidos, por motivos de raza, color, religión, sexo, origen nacional, edad, discapacidad, afiliación o creencia política y a cualquier beneficiario de los programas que reciba asistencia financiera en virtud del Título I de la Ley de Inversión en la Fuerza Laboral (WIOA, por sus siglas en inglés) de 2014 por la ciudadanía/condición de inmigrante legalmente admitido del beneficiario autorizado para trabajar en Estados Unidos o su participación en cualquier programa o actividad de asistencia financiera en virtud del Título I de la WIOA. El destinatario no deberá discriminar en ninguna de las siguientes áreas: Decidiendo quién será admitido o tendrá acceso a cualquier actividad del programa de asistencia financiera en virtud del Título I de la WIOA; brindando oportunidades o tratando a cualquier persona en relación a dicho programa o actividad; o tomando decisiones de empleo en la administración o en relación a dicho programa o actividad.

 

QUÉ HACER SI CREE

 QUE HA SIDO DISCRIMINADO

 

Si cree que ha sido discriminado en el programa o actividad de asistencia financiera en virtud del Título I de la WIOA, puede presentar un reclamo dentro de un periodo de 180 días de la supuesta violación ante:

 

El Funcionario de Oportunidades Igualitarias del destinatario (o la persona que el destinatario haya designado para este fin); o

El Director del Centro de Derechos Civiles (CRC, por sus siglas en inglés) del Departamento de Trabajo de Estados Unidos 200 Constitution Avenue NW, Room N-4123, Washington, DC 20210.

 

Si presenta su reclamo con el destinatario, usted debe esperar hasta que el destinatario emita una Notificación escrita de Acción Final o hasta que hayan pasado 90 días (lo que suceda primero) antes de presentarlo ante el Centro de Derechos Civiles (ver dirección antes mencionada). Si el destinatario no le entrega una Notificación escrita de Acción Final dentro de un periodo de 90 días del día en que presentó su reclamo, no tiene que esperar a que el destinatario emita esa Notificación antes de la presentación del reclamo ante el CRC.  Sin embargo, debe presentar su reclamo ante el CRC dentro de un periodo de 30 días de la fecha límite de 90 días (en otras palabras, dentro de los 120 días después del día en que presentó su reclamo ante el destinatario). Si el destinatario le entrega una Notificación escrita de Acción Final sobre su reclamo, pero usted no está satisfecho con la decisión o la resolución, puede presentar un reclamo ante el CRC.  Usted debe presentar su reclamo ante el CRC dentro de un periodo de 30 días de la fecha en que recibió la Notificación de Acción Final.
